Fort Worth City Council member accused of violating probation
A motion to revoke the probation of Fort Worth City Council member Cary Moon has been filed in Johnson County court after he was accused of violating the terms following his DWI conviction.
Moon pleaded no contest to driving while intoxicated on June 2 and was sentenced to 18 months of probation. He violated the terms of his probation by drinking alcohol, failing to submit to urinalysis testing, failing to complete community service and traveling out of state without permission, according to court documents.
Moon’s ignition interlock device recorded high alcohol readings 12 times from June 2 to July 2 and five times from July 21-Sept. 10, according to court records.

An arrest warrant was issued Oct. 28. Moon said he paid the $10,000 bond in cash. A hearing on the motion to revoke his probation is scheduled for Jan. 18.
Moon called the violations listed in the court documents “allegations,” and said he has documents to refute the alcohol violations. He admitted that he had a glass of champagne on June 23, which Moon said was for his wedding anniversary.
Moon said he failed to submit to urinalysis testing on Sept. 24 because one of his children came home from school with COVID-19 symptoms. Both Moon and his daughter tested negative for COVID-19, and he said he submitted for urinalysis testing the following Monday.
In a text message, Moon said he answered each individual allegation and that he looked forward to “disprove the administrative failings” of the court.
Moon, 51, was arrested by Burleson police in October 2020 after the truck he was driving rolled through a stop sign, hit a curb, went onto the grass and back onto the road, according to police.
At the time, Moon told the Star-Telegram he had been at Dalton’s Corner, a bar and restaurant at 200 S. Main St. in downtown Burleson that he partially owns.
“I will be responsible for my actions,” he said.
Moon announced Tuesday that he will run for the Texas Legislature’s District 93 seat held by Matt Krause, who is running for attorney general. Moon can serve in an acting position on the City Council until his replacement is selected in May 2022.
Moon represents District 4, which runs from Beach Street east to Loop 820 between Interstate 30 and Airport Freeway and into far north Fort Worth, including the Park Glen, Summerfields and Heritage neighborhood developments. He was first elected to the City Council in 2015 and is the second longest serving member after Mayor Pro-Tem Gyna Bivens.
