Three Texas lawmakers gathering signatures from colleagues to urge the State Supreme Court to allow enforcement of criminal penalties under 1925 total abortion ban
Chairs Creighton, Cain, and Burrows have drafted an argument and are gathering signatures from senators and representatives
Here is the
legal argument from Chairmen Brandon Creighton, Briscoe Cain, and Dustin Burrows.
At the bottom of the document you can see they’re
looking to sign up senators and representatives to support their position. Under the state's 1925 total abortion ban, the person who performed an abortion would face two to ten years in prison.
The Texas Supreme
Court has already found that Attorney General Ken Paxton can
enforce the 1925 total ban on abortion through civil litigation.
