Legal experts say rhetoric is causing great confusion about immigration executive order

“This is a preliminary injunction, not a ruling on the merits"

Those who work with immigrant communities in cities across Texas say they are scrambling to contain confusion caused by what they called “political spin” about the temporary injunction against President Obama’s most recent executive order on immigration.

One of the main points of confusion, those advocates said, is that many young immigrants think they are no longer eligible for deferred action under Obama’s 2012 executive order. But, they still are because this week’s ruling has nothing to do with that.

The other problem is the absolutist rhetoric used by top Texas Republican leaders to describe the injunction leaves many believing this case is over when it is just beginning.

“This is a preliminary injunction, not a ruling on the merits,” said Professor Geoffrey Hoffman, Director of the Immigration Clinic at the University of Houston Law Center.
